The SSDI Appeals Process

For SSDI applicants who have had their initial claim denied, there are several levels of appeal:

  • Reconsideration: After your claim is denied, you will have 60 days to file a Request for Reconsideration. During this time, your claim will be revaluated by another examiner to determine if an error was made in the first round.
  • Administrative Law Judge hearing: Most requests for reconsideration are denied. When this happens, you have an additional 60 days to ask for an administrative hearing. At the hearing you can present your claim and provide new or omitted evidence to an administrative law judge who will make a ruling.
  • Appeals Council review: If the administrative judge rejects your appeal, you will have 60 days to request review of the ruling by the Appeals Council. The council will work to determine whether the administrative law judge made any errors when they evaluated your case.
  • Civil lawsuit in federal District Court: Some, but not all cases must be filed in the District Court. Our office has experience with these types of lawsuits, and we can provide the further help you may need.
